How to File a Claim with the W.I.T.

 

BASIC INFO

 

>   Normally, WIT does not show any of its clients' case materials online unless requested, needed or desired for a purpose.

>   The prospective client will prepare basic account of his concern / complaint etc.  It must contain true statements concerning

1. his name/address/contact info  and the same of his adversary 2. specification of services he is seeking from the W.I.T. 3. brief statement of the nature of the incident he is presenting  4.  basic facts of the case : what happened, when, how, ...  5. itemized evidence in support  6. account of actions taken in other courts and their results  7.  damages he is seeking and why.

>   If a cliet's account happens to be too wordy, redundant, or irrelevant, WIT will modify, abbreviate, organize or reduce the material         and its scope to suit the purpose and be more manageable, clear, and organized.  If too messy, we may return it for revision.

>   Communication will take place via e-mail and regular postal service,  and occasionally via personal contact or telephone.

>   Client needs to keep the copies or files of all important material mailed to us. He will also provide the initial paperwork to his opponent with a request to answer to the charges.

>   WIT will briefly assess the case and decide if it wants to take it.  If so, WIT will inform the client about its soundness, legibility, vi- ability, defects, drawbacks, chances for him to prevail, complexities, if any, special features, and the like. WIT will agree on the extent of the work, will outline its details, depth, and so on. WIT will not seek to formally sign any separate agreements or contracts but, rather,  merely rely and depend on the mutual written or verified communication.  

>   Upon payment of the filing fee (approx. 100 Euros in the EU, $100 in the U.S. and 1,000 Czk in CZ) WIT will proceed with the work.  In simple cases, the verdict may be available within as little as 1 to 3 months.  Otherwise in 3 to 6 months.  If some unforseen problems arise (such as an illness on either side) we still make a commitment to be through with our work no later than within a year.

  For the basic requirements to file a complaint refer to the a- bove. It should consist of 2 to 4 pages of typed or printed text and exhibits.  Among the latter must figure a copy of a prior judgment if such exists and WIT is sup- posed to do its review.  Do your homework well to help us move the case aong.
 
Rules of court based on simplified U.S. Federal Rules of Civil Proce- dure  are followed here and will soon be post in this section.
 
Discovery of Facts / Evidence
 
WIT client must provide all the e- ssential facts of the case in truth and as accurately as possible with places and times and other circum stances given.
  Client's honesty and truthfulness are crucial to avoid confusion and delays. In most cases WIT will ha- ve to request additional info. This should be necessary, hopefully, no more than once.
 
 
Litigation-Judgment-Appeals
 
This is a virtual on-line situation.
Hence, no personal attendance or appearance will be necessary any- where. No hearings, no trial, ...
  Therefore, WIT will rely on the written communication which has to be carefully and thoughtfully e xecuted by all parties. Let us re- member that often the Defendant may not be adequately cooperati- ve. However, this will, as a rule, speak against him resulting, for example, in his default or prejudi- cing his case.
